Digiviz will endeavour to carry out its services related to your project by the agreed date included in the attached documents. Should we be unable to meet the targeted dates for completion we will discuss this with you at the earliest possible time and agree on a revised programme.

Unless previously agreed, if the time for completion of our work is extended by you beyond 12 months from the date of engagement, Digiviz reserves the right to charge additional fees although we would make sure you are aware of any extra costs as the situation arises.

Digiviz's costs will be discussed and the basis of our fees agreed at the earliest possible time. Often we will need to complete some preliminary design work before we can establish the full scope and cost of the services involved. Generally this initial work will be charged on a time plus costs basis unless we agree otherwise.

We will invoice you monthly, in stages as our work progresses. All accounts are payable in full within 14 days of the invoice date. Interest is charged on overdue accounts at the rate of 2% per month and a $20 admin fee. This includes progress claims that are made during the course of our work, Digiviz will pass on any costs incurred in the collection of overdue accounts.

You will provide Digiviz Limited with legal, survey or other information relating to the project as soon as practically possible after its request and free of charge.

Digiviz will keep up to date records for all relevant time and reimbursable costs for services carried out on a time charge basis.

You can suspend all or part of Digiviz’s services or terminate our agreement by notifying us. We will immediately arrange to stop work and minimise further expenditure. We will be reimbursed for time charged and costs incurred on a quantum merit basis. Suspension or termination will not prejudice or affect accrued rights, claims or liabilities of either party.

Digiviz retains copyright for all documents and electronic files we have prepared, You may use or copy the drawings, specifications and other documents but only for the specific project for which they are intended. You own any data and factual information collected by Digiviz after your full payment is received. However if you have not paid us as agreed, then you will have no legal right to any of the documents.

Under no circumstances will Digiviz's liability exceed 10 times the fee paid for our services and any claim will be limited to this amount.

If you or your contractor depart from any aspect of Digiviz Limited design that may affect the operation, structural Integrity or weather tightness of any building work, without our written consent, then we have no liability.
